In a recent op-ed for The Washington Post, President Joe Biden laid out a series of sweeping proposals aimed squarely at reshaping the Supreme Court, a move that raises serious questions about his intentions and the implications for American jurisprudence. Amid ongoing assaults on previous court decisions regarding presidential immunity and abortion, Biden’s latest push has the potential to fundamentally alter the high court’s operation and independence.

Biden revealed three major changes he’d like to see before the end of his presidency: imposing term limits for justices, instituting a new ethics code, and amending rules around presidential immunity. Echoing a mantra that “no one is above the law,” Biden’s rhetoric seems crafted to paint the Supreme Court—particularly its conservative majority—as a rogue entity that needs to be reined in.

Biden’s ire was particularly stirred by the Supreme Court’s recent 6-3 ruling in favor of former President Donald Trump’s claim of broad presidential immunity when exercising core constitutional powers. Biden argued this decision could grant presidents unchecked power, enabling them to commit crimes without consequence. His proposed amendment aims to eliminate any doubt that a former president could face criminal charges for actions taken while in office.

Moreover, Biden’s campaign didn’t mince words in calling the court the “Trump Supreme Court,” asserting it diverges from what the founders intended. This ongoing narrative serves Biden’s agenda by perpetuating the notion that the court is an extension of Trumpism, particularly in light of its pivotal decision to overturn Roe v. Wade and return the issue of abortion to the states.

Biden also wants to introduce term limits for Supreme Court justices, suggesting an 18-year cap with staggered appointments every two years—a move that seems suspiciously aimed at diminishing the lasting influence of Trump’s three appointed justices and ensuring a more predictable, less “arbitrary” court composition.

Ratcheting up his campaign against the court, Biden called for a new ethics code amid a flood of media scrutiny targeting conservative Justices Clarence Thomas and Samuel Alito over financial disclosures. However, it’s hypocritical, given that liberal Justice Sonia Sotomayor has also faced ethical questions, particularly after The Daily Wire reported her decision not to recuse herself from cases involving Penguin Random House, the company that paid her millions for a book deal.

Biden pointed to “undisclosed gifts to justices from individuals with interests in cases before the court, as well as conflicts of interest connected with Jan. 6 insurrectionists,” as raising “legitimate questions about the court’s impartiality.” Once again, it’s worth noting how these attacks are laser-focused on conservative justices, ignoring the transgressions of their liberal counterparts.

These sweeping proposals are expected to face significant opposition. Republicans have already signaled their resistance, arguing that Biden’s plans are clearly aimed at further politicizing the court. It’s crucial to consider the broader implications of such changes: would term limits and new ethical codes serve the public good, or are they a thinly veiled attempt to undermine the court’s conservative majority?

    I think it will help elect Kamala if she is the president. Terrifying to think of Biden with finger on the red button but would you feel safer with Kamala in charge?

    He’s committed no impeachable offences. He can want to change the Supreme Court all day long but he doesn’t have the power to do so – he’s just making noise.

    Impeach for what? What crimes, exactly? He’s not wrong that the court is out of control – they can’t even police Clarence Thomas for his misdeeds.

    Does anyone actually think demented Biden has the cognizance to not only think clearly and/or to make a decision like this on his own? Not in a million years. Someone behind the scenes thought it up and has pressed Biden to repeat what he’s been told. And that “someone” has been doing this for a very long time.

    Why is he even still in the White House? If he is unable to do the work he should be removed if he will not leave, through Article 25 of the Constitution. He proves he is incapable every day. This nation is flounding without a proper leader guiding it. Obama is not a proper leader.
